We really dislike posting anything like this but we prefer to have a 'level playing field'. Some competitors have been taking a lot of liberties lately regarding "terms of use". We felt it was necessary to make marketers aware of the potential problems they will encounter if they fail to read the "terms of use" they will find on many web sites.

We receive a lot of messages relating to our "terms of use". And the vast majority of messages are simply looking for us to confirm that what we have stated is what we actually deliver.

In some instances the messages state that the potential customer feels the need to have confirmation because they have encountered many web sites that contain puzzling "terms of use".

Being competitive, we always check the web sites referred to by our customers. And even we have been astonished at some of the recent wording contained in the "terms of use".

Several competitors have been using the following terms and they are simply an outrageous attempt to try and force the customer to continue using their service or lose all rights to the products they obtained. One example is, "Note, when your account has expired at SR, you will lose all rights to resell rights license, master resell rights license, private label rights license and give away rights license granted to you by SR. The licenses that you lose are applied to all products that you downloaded from SR." With 2nd Income Solutions rights are never voided once payment is completed and we do not require customers to purchase the next yearly edition to continue with usage rights. Another example is, "Restrictive License: "As soon as you cancel your membership, all your licenses to all materials from NicheWholesaler.com shall be null and void. Your access to the secure members’ area shall also be instantly deleted."

What they are stating in simple terms is that even if you spent several hundreds of dollars over the years to be a member of Super-Resell or NicheWholesaler.com, or some other membership sites the moment you leave you can no longer sell those products. The countless hours of downloading products, extracting products and then uploading products to your web sites, the expense related to hosting, web design, etc; are now worthless!

To be blunt, this is a half-assed scare tactic that is illegal!

The resell rights are granted to customers by the developer of the product. Licenses are not granted by the marketer selling the product. In this instance SR is attempting to override the license granted by the developer. Ahhh, you can't do that! And from a legal standpoint even the developer cannot change the usage terms relating to a product that was already sold.
